Sin embargo, aunque la ley trata de proporcionar prestaciones a los trabajadores enfermos y lesionados, tambi\u00e9n obliga a cumplir estrictamente los requisitos de elegibilidad y procedimiento.<\/p>\n<h2>\u00bfPor qu\u00e9 me han denegado la indemnizaci\u00f3n en Utah?<\/h2>\n<p>En Utah, al menos\u00a0<strong>28%<\/strong> de reclamaciones de indemnizaci\u00f3n fueron denegadas por el Departamento de Trabajo de EE.UU. El punto de partida para la existencia del derecho a reclamar la indemnizaci\u00f3n de los trabajadores es a partir de la fecha en que se produjo la lesi\u00f3n.<\/p>\n<p>Por ello, es esencial que despu\u00e9s de haber recibido el tratamiento necesario, usted <strong>informe directamente a su empleador.<\/strong> <\/p>\n<p>Una vez que se lo haya notificado debidamente a su empresario, \u00e9ste deber\u00e1 presentar el Informe Patronal necesario y remitirle una copia a usted y a la compa\u00f1\u00eda de seguros en un plazo de siete d\u00edas. <\/p>\n<p>El primer paso es vital porque el retraso le es imputable a usted, mientras que el segundo recae exclusivamente en el empleador. No obstante, si bien puede admitirse una solicitud tard\u00eda, debe ser por una raz\u00f3n v\u00e1lida.<\/p>\n<h3>Falta de explicaci\u00f3n<\/h3>\n<p>Uno no puede limitarse a afirmar que se lesion\u00f3 a causa de su trabajo. Tambi\u00e9n debe ser capaz de explicar c\u00f3mo se produjo la lesi\u00f3n. <\/p>\n<p>Por tales motivos, los informes m\u00e9dicos son siempre los primeros documentos que deben remitirse para probar la existencia de la lesi\u00f3n y c\u00f3mo se sufri\u00f3.<\/p>\n<h3>Lesi\u00f3n preexistente<\/h3>\n<p>Uno de los requisitos esenciales para que un trabajador pueda reclamar prestaciones de indemnizaci\u00f3n es que la lesi\u00f3n o enfermedad se haya adquirido cuando estaba realizando su trabajo. Cualquier afecci\u00f3n que haya existido con anterioridad a la lesi\u00f3n provocar\u00e1 la denegaci\u00f3n autom\u00e1tica de las prestaciones a reclamar.<\/p>\n<h2>C\u00f3mo recurrir la denegaci\u00f3n de una indemnizaci\u00f3n por accidente laboral<\/h2>\n<p>Que le denieguen la reclamaci\u00f3n no significa que no tenga ninguna posibilidad de ser indemnizado. A continuaci\u00f3n te indicamos los pasos que debes dar para seguir adelante con tu reclamaci\u00f3n de indemnizaci\u00f3n.<\/p>\n<h3>1. P\u00f3ngase en contacto con la aseguradora de su empresa<\/h3>\n<p>Antes de presentar un recurso, p\u00f3ngase primero en contacto con la aseguradora de su empresa para averiguar el motivo de la denegaci\u00f3n de dicha solicitud. <\/p>\n<p>Si el rechazo se basa en la falta de documentos o en el retraso de la solicitud, siempre puede intentar convencer a su aseguradora para que pase por alto o reconsidere el error.<\/p>\n<h3>2. A continuaci\u00f3n se presentan las dos formas de acuerdos de resoluci\u00f3n.<\/p>\n<h4>Acuerdo de compromiso<\/h4>\n<p>Un acuerdo transaccional es b\u00e1sicamente cuando la compa\u00f1\u00eda de seguros acepta compensar los gastos actuales y anteriores en que haya incurrido el demandante. <\/p>\n<p>Al aceptar un acuerdo de este tipo, el trabajador renuncia a todos sus derechos a reclamar una indemnizaci\u00f3n por los costes futuros. En resumen, s\u00f3lo se asegura una parte de las prestaciones.<\/p>\n<h4>Acuerdo de conmutaci\u00f3n<\/h4>\n<p>En cambio, un acuerdo de conmutaci\u00f3n es aquel en el que las tres partes (demandante, aseguradora y juez) acuerdan una cantidad exacta o una estimaci\u00f3n destinada a compensar los gastos m\u00e9dicos futuros.<\/p>\n<p>El acuerdo significa que s\u00f3lo se reembolsar\u00e1n los gastos en que se haya incurrido despu\u00e9s de la fecha del entendimiento.\u00a0<\/p>\n<p>Cuando exista un acuerdo entre usted y el empleador, aseg\u00farese de que \u00e9ste quede plasmado en un documento escrito, de modo que todas las reclamaciones puedan desestimarse tras la aprobaci\u00f3n de la Comisi\u00f3n Laboral de Utah.<\/p>\n<h3>3.
